Well, I asked because I was thinking of what charges could be filed against him.  Can't be assault with a deadly weapon because no assault took place.  Is it legal in his area to discharge a gun in his home?

i reckon im lucky ive never had neighbors within  a mile of my home .  and  im 51,   now beach house i got a cool neighbor separated by some  thicket   but he looks like billy bob thorton  and has a partner .

wait  wait  wait , i carry a conceall 380 sometimes and its loaded with some hot loads from underwood ,  the gelatin test passed the 9mm  and ripped the gel test up  .

Seriously? 

Reckless endangerment, discharge of a firearm within city limits, and criminal damage are three charges I can think of. 

Shooting off a firearm in an occupied multi-party residence [an apartment building] brings about the reckless endangerment. Shooting inside of the city limits is a prima facie felony crime, and criminal damage applies since the bullets would have struck real property [the walls, ceiling, and substructures] belonging to another [the property owner].

In Arizona, Aggravated Assault requires only use of a deadly weapon [a firearm] and "Intentionally placing another person in reasonable apprehension of imminent physical injury". Shooting into an occupied residence certainly fits the legal statute.
