Few realize that the case it came from, Schenck v US, convicted Schenck, under the Espionage Act of 1917, for printing and distributing 15,000 flyers calling for men to resist the draft in World War I. The draft resistance flyers were liked to shouting fire. Obviously, the ruling was gradually reversed. Otherwise, Vietnam War draft resistance advocates would have gone to jail.
