Muncie man faces gun-pointing, battery allegations
 
MUNCIE, Ind. – A Muncie man is accused of pointing a handgun at a man he apparently viewed as a romantic rival, and then using the same firearm to threaten a woman while he was trying to hide from police.
 
Eugene Cliff Penny, 38, was arrested Friday on preliminary counts of pointing a firearm, intimidation, domestic battery, strangulation and carrying a handgun without a license.
 
City police late Friday morning were first called to a home in the 1700 block of North Granville Avenue, where a man reported Penny had threatened him and, while pulling away in a car, pointed a handgun at him.
 
The man said Penny was upset he had sent a text message to a mutual female acquaintance.
 
A short time later, Penny – and a handgun – were found in an apartment in the 2500 block of North Elgin Street after a woman there was heard shouting for help.
 
That woman – who was not the recipient of the text message that led to the Granville Avenue incident – said Penny had forced his way inside, “slammed a handgun on the table” and told her he was hiding from police.
 
The woman said when she insisted he leave, Penny grabbed her by the throat and threw her down, then pointed his gun at her head and said, “You’re going to die now.”
 
Penny, released from the Delaware County jail on Saturday after posting a $25,000 bond, at the time of his most recent arrest already faced three charges – domestic battery, carrying a handgun without a permit and driving as a habitual traffic offender – in court cases pending in Delaware and Madison counties.
 
According to court records, the Muncie man has been convicted of possession of cocaine (at least three times), resisting law enforcement, possession of marijuana (three times), driving while intoxicated, driving as a habitual traffic violator, driving while suspended and visiting a common nuisance.
