Teacher accused of assaulting 6th grader for sitting during the pledge of allegiance.

There's a long running thread on Glock Talk about this issue based on personal opinion. I figured let's have a discussion on the constitutionality of said action or actions of the parties involved.

While I am not a Lawyer, I believe the student had a first amendment right to not stand for the pledge based on my interpretation of the Tinker Case. 

 

What do do all of you think?

It would be tough to argue with your interpretation, I think....based on the Tinker Case. I will say the kids has fortitude wrong or right. Using what he believes is his right to levy a platform for what he believes is not warranted by The Constitution and against his personal ideology  without infringing upon another's right is always something in my opinion we should encourage.
